2. Acceptance of the terms and conditions :
The Customer acknowledges having read, at the time of placing the order, the specific terms and conditions of sale displayed on this screen and expressly warrants that he/she accepts them unreservedly.
These general conditions of sale govern the contractual relationship between MOULIN MARICERA and its Customer, both parties accepting them unreservedly. These general terms and conditions of sale shall prevail over any other terms and conditions set out in any other document, unless expressly exempted in writing in advance. The Customer declares that he/she has full legal capacity to be bound by these General Terms and Conditions and acknowledges that he/she has checked that the IT equipment he/she is using is secure and in good working order.
3. Products :
All products comply with the requirements of the French law in force. Any photographs depicting the products are not contractual in nature. MOULIN MARICERA cannot be held liable for any errors that may have been made. The operator endeavours to ensure the optimum availability of its products. Product offers are subject to availability. However, despite the best efforts of the operator, if a product is not available following the Customer’s order, MOULIN MARICERA will inform the Customer as soon as possible by email to cancel or amend his/her order.
4. Orders :
Orders: The order placed by the Customer will be validated once payment has been confirmed and an order confirmation email has been sent to the email address provided by the Customer when placing the order. The sale will only be finalised once the order has been confirmed. MOULIN MARICERA reserves the right to cancel any order from a Customer with whom there is a dispute relating to the payment of a previous order. Entering the contact details of the buyer when placing an order is fully binding on the latter. In the event of an error concerning the postal address and/or the delivery address of the pick-up point and/or the email address and/or the identity of the Customer, which could lead to a potential delivery problem, MOULIN MARICERA cannot be held liable.
5. Delivery : Mainland France and abroad
In accordance with the rules of procedure of Mondial Relay or its partner subsidiaries for deliveries outside mainland France, particularly with regard to volume and weight constraints depending on the quantity ordered, we reserve the right to use another delivery method suitable for the quantity ordered. Road transport, for example.
After confirming the order, MOULIN MARICERA undertakes to deliver all the items ordered by the buyer within a maximum of 5 business days. All orders placed with MOULIN MARICERA are for the personal use of its Customers. Customers or recipients of the products shall refrain from any partial or total resale of the products. MOULIN MARICERA declines all legal liability if the Customer fails to pay any taxes on the products. Any delays do not entitle the buyer to claim compensation. In the event of absence, a third party authorised by the Customer may take delivery of the parcel. Always check your parcel upon arrival. In the event of apparent defects, the buyer has the right to return the goods under the terms and conditions set out herein. The following are considered to be cases of force majeure releasing the seller from its obligation to deliver: war, riots, fire, strikes, accidents, health crises and failure to be supplied. Goods are always shipped at the risks of the recipient. In the event of missing products or damage, indicate the appropriate reservations. If the Customer would like a delivery to two different locations, he/she must place two orders, and pay the associated delivery charges. For delivery to a pick-up point, the Customer has 14 days in which to collect the parcel from the pick-up point. If, however, the Customer does not collect the parcel within the allotted time, he/she will be fully liable for the shipping costs associated with re-sending the order.
6. Cancellation :
You have 7 days (from receipt of the items) to form an opinion, and only for non-food products. In the event of an exchange or refund, return the new item(s) in its (their) original packaging, undamaged, along with any accessories, instructions and documentation to the following address:
837, Campagne MISTRAL
route des Fioles
If the right to cancel is exercised, MOULIN MARICERA is obliged to refund the sums paid by the Customer, free of charge, with the exception of the actual cost of returning the goods. The refund will be made within a maximum of 15 days.
EXCEPTIONS TO THE RIGHT TO CANCEL
In accordance with the provisions of Article L.121-21-8 of the French Consumer Code, the right to cancel does not apply to:
– The supply of goods made to the consumer’s specifications or clearly customised.
-The supply of goods that are likely to deteriorate or expire rapidly.
-The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for hygiene or health protection reasons.
-The supply of goods which, after delivery and due to their nature, are mixed in with other items.
7. Price :
The price is stated inclusive of tax in Euros (€)
The price indicated on the product sheets does not include shipping.
The price shown in the order confirmation is the final price, inclusive of all taxes and including VAT for France and the EEC (European Economic Community). This price includes the price of the products, handling, packaging and storage costs, shipping and commissioning costs.
Delivery in France and abroad:

Crédit Agricole allows you to pay online via a Crédit Agricole bank server.
Your bank card number is therefore directed to the bank’s servers, and your payment is made directly to a bank in a secure environment without passing through the shop’s server. This guarantee is all the more important as your bank card numbers and details are known only to our banking partner (Crédit Agricole).
Any order validated by the Customer will not be considered effective until the bank payment centres concerned have given their approval. If the centres refuse, we are not given any explanation. This refusal will result in the cancellation of the order and the Customer will be informed by email. Furthermore, MOULIN MARICERA reserves the right to refuse any order from a Customer with whom there is a dispute.
9. Disputes :
This contract is governed by French law. MOULIN MARICERA cannot be held liable for damages of any kind, whether material, immaterial, including personal injuries, which may result from a malfunction or improper use of the products sold. The same applies to any modifications made to the products by the manufacturers. The liability of MOULIN MARICERA will, in any event, be limited to the amount of the order and it cannot be held liable for simple errors or omissions which may have occurred despite all the precautions taken when presenting the products. In the event of difficulties in the application of this contract, the buyer is entitled, before taking any legal action, to seek an amicable solution, in particular with the help of a professional association in the sector, a consumer association or any other advisor of his/her choice. It should be noted that seeking an amicable solution does not interrupt the “short period” of the legal warranty, nor the duration of the contractual warranty. As a general rule, and subject to the discretion of the courts, compliance with the provisions of this contract relating to the contractual warranty, presupposes that the buyer honours his/her financial commitments to the seller. Complaints and disputes will always be accepted attentively, good faith always being presumed in individuals who take the time to explain their situation. In the event of a dispute, the Customer must first contact the company to obtain an amicable solution. Failing this, the Commercial Court of Tarascon (13) shall have sole jurisdiction, regardless of the place of delivery and the payment method accepted.
10. Warranty :
MOULIN MARICERA guarantees that all the food products selected are made in France. With regard to food products, the Customer must comply with the consumption dates indicated.
In all cases, MOULIN MARICERA cannot be held liable for non-compliance with the regulatory and legislative provisions in force in the country of receipt. MOULIN MARICERA’s liability is systematically limited to the value of the product in question, on its date of sale, with no possibility of recourse against the brand or company producing the product. In any event, the Customer benefits from the hold harmless clause and the legal warranty against hidden defects (Art.1625 et seq. of the French Civil Code). Provided that the buyer can prove the hidden defect, the seller must legally remedy all the consequences (Art.1641 et seq. of the French Civil Code). Failure to provide this information will result in the order not being validated. In accordance with the French Data Protection Act, Article 34 of the Act of 6 January 1978, as amended in 2004. The Customer has the right to access, amend, rectify and delete data concerning him/her, which he/she may exercise by contacting MOULIN MARICERA at the following address: email@example.com. Any personal data or information collected concerning you is necessary to process your order, as well as to improve the services and information that we send you. In addition, MOULIN MARICERA undertakes not to disclose, either free of charge or in return for payment, the contact details of its Customers to any third parties.
